Abstract

                The Bhartiya Nyaya Sanhita 2023 (BNS 2023) introduces vital reforms aimed at strengthening protections for women against domestic violence in India. Recognizing the multifaceted nature of domestic abuse, BNS 2023 expands the definition to include not only physical but also emotional, sexual, and economic abuse. This comprehensive approach ensures that a broader range of harmful behaviors within the home are addressed, enabling law enforcement to respond more effectively.

BNS 2023 also imposes stricter penalties for repeat offenders and enhances legal provisions for emergency protective measures, such as restraining orders. This is complemented by improved access to support services for survivors, including legal aid, counseling, and shelters. By emphasizing support alongside punitive measures, the code aims to provide survivors with the resources necessary to rebuild their lives.

Furthermore, the reforms place a strong emphasis on specialized training for law enforcement officers, promoting a more sensitive and efficient handling of domestic violence cases. Despite these advancements, challenges such as social stigma, underreporting, and limited resources for survivor support persist, which could hinder the code’s effectiveness in practice.

To ensure BNS 2023 fulfills its potential, there must be a concerted effort to raise awareness, reduce stigma, and expand support infrastructure for affected women. While the new code marks significant progress, its success in protecting women from domestic violence will rely on both societal and systemic changes.
